Energy Performance Certificates

New legislation came into force in April 2018: the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015.

Legislation summary:

Private domestic and non-domestic landlords (excluding social landlords) must ensure that properties they rent in England and Wales reach at least an Energy Performance Certificate (EPC) rating of E before granting a tenancy to new or existing tenants.

Improvements to the properties that fail to meet these standards will only be required to do so if there is third party finance at "no cost to the landlord". There are currently no schemes which are at no cost to the landlord which are provided by Sedgemoor District Council, Taunton Deane Borough Council or West Somerset Council.

An EPC is still a legal requirement for new tenancies and existing tenancies, but not if it was occupied before October 2008. EPCs are valid for 10 years.

There are other exemptions from the legislation which can be found in the guidance.

From the 1st February 2016, landlords with property in England will have to carry out quick and simple checks to ensure potential tenants have the right to rent property in the UK. These can be done from 28 days before the start of a tenancy agreement.
